Who Does NOT Qualify for IFICI

IFICI is a narrower regime than the NHR it replaced, and several groups who benefited under the old rules do not qualify under the new one. See exactly who is excluded and why.

Situations IFICI does not cover

IFICI is defined under Article 58-A of Portugal's Tax Benefits Statute and implemented through Portaria n.º 352/2024/1, which sets the professions, the activity codes and the deadlines referred to above. This page is general information about the regime and does not constitute tax or legal advice. Individual cases turn on individual facts.

Cases that look excluded but often are not

The exclusions above are real, and so is the opposite mistake. These three situations are read as disqualifying far more often than they actually are.

Still not sure where you stand?

IFICI has six active eligibility routes, and many people assume they don't qualify when they actually do, or the reverse. The fastest way to know for certain is our free eligibility check.

IFICI does not cover pension income, foreign or Portuguese. Pensions are taxed at standard progressive rates regardless of IFICI status.

Passive investors with no qualifying activity

Dividends, rental income, and capital gains do not themselves qualify for the 20% rate. If passive income is your only income in Portugal, there is nothing for IFICI to apply to.

Remote employees of foreign companies with no Portuguese entity

Working remotely for a company with no Portuguese economic presence does not qualify, regardless of your profession or salary.

Anyone who was a Portuguese tax resident in the previous 5 years

This is a hard requirement with no exceptions.

Anyone who has already benefited from NHR or Programa Regressar

IFICI cannot be combined with either, this exclusion is permanent.

Anyone claiming IRS Jovem for the same year

The youth IRS regime and IFICI cannot be applied together. You choose one, and for a young qualifying professional the arithmetic is worth running before deciding.

Roles outside the published lists, on the highly qualified professions route

That route works off two lists in Portaria n.º 352/2024/1: the profession codes in Annex I, and the industrial and services activity codes in Annex II. A senior role at a company whose main CAE code sits outside Annex II, and which neither benefits from RFAI investment incentives nor exports at least 50% of turnover, has nothing to attach to.

Applicants who cannot meet the qualification bar on that route

The highly qualified professions route requires EQF Level 8, a doctorate, or EQF Level 6, a bachelor's degree, together with three years of documented professional experience. The certified startup route is assessed differently, on the company's Law 21/2023 certification and a genuine remunerated role.

The activity has to be genuine and remunerated for work performed in Portugal, and you must be able to produce contracts, invoices and income records on request. A title without pay and substance does not create eligibility.

The application is due by 15 January of the year after you become resident. Missing it puts that year outside the regime, and the deadline is not routinely extended.

If the group has a Portuguese entity and you are actually employed or contracted by it in a qualifying role, the picture changes completely. It is the Portuguese employment and the entity's status that matter, not the parent company's flag.

Passive income plus one qualifying activity

Passive income does not qualify on its own, but a single genuine qualifying activity can bring the rest of your income into the regime's foreign income exemption. Many investors assume they are excluded when the missing piece is one qualifying role.

Retiree with a board seat or consultancy

Pension income stays on progressive rates whatever you do. A genuine, remunerated board seat or advisory activity can still qualify separately, so retirement itself is not always the end of the conversation.

Does foreign income from a blacklisted jurisdiction still get the exemption?

No. The foreign income exemption under IFICI does not apply to income from jurisdictions on Portugal's list of countries with clearly more favourable tax regimes. Portuguese source income from the qualifying activity is still taxed at the 20% rate, but the exemption limb falls away for income sourced in those jurisdictions.

I was a Portuguese tax resident years ago. Does that block me?

Only if it falls inside the five years before the year you now become resident. Residency further back than that does not block an application, although you should be able to evidence the years in between.

Can retirees get any tax benefit at all in Portugal?

Not through IFICI. Portugal's standard progressive tax rates apply to pension income regardless of IFICI eligibility elsewhere.

I work remotely for a US company, does that disqualify me?

If your employer has no Portuguese entity and your role has no Portuguese economic connection, yes, this is one of the most common reasons people assume they qualify when they don't.

If I don't qualify now, can I qualify later?

Only if your situation changes, for example taking on a qualifying role. The 5-year residency clock and the NHR/Programa Regressar exclusion are the only truly permanent disqualifiers.
