IFICI for Remote Workers

IFICI for remote workers depends entirely on whether your role has a genuine Portuguese economic connection, not on where you work from, which is why most remote workers who move to Portugal for IFICI do not actually qualify.

Where remote workers stand

Remote work for a foreign employer does not qualify

Working remotely for a company with no Portuguese entity and no Portuguese economic presence does not qualify for IFICI, regardless of your profession or your salary. This is the single most common reason people assume they qualify when they do not.

Qualification is possible only where the remote role is restructured through a genuine qualifying activity, for example becoming an employee or board member of a Portuguese entity, or taking on a role that fits one of the six IFICI eligibility routes. We would rather tell you this before you move than after.

What actually decides your position

IFICI is defined under Article 58-A of Portugal's Tax Benefits Statute and implemented through Portaria n.ยบ 352/2024/1.

Documents typically requested

Once a qualifying role is in place: the employment contract or governing body appointment with the Portuguese entity, evidence of the entity's qualifying status for the relevant route, proof that the work is performed in Portugal, and payroll or invoicing records showing genuine remuneration. Exact documentation varies by case.

check your IFICI eligibility first

Working remotely for a foreign employer with no Portuguese entity does not qualify, regardless of your profession or your salary.

IFICI looks at whether the role is exercised through a qualifying Portuguese activity or entity, not at where you physically sit while working.

A remote arrangement can qualify only if it is restructured into a genuine qualifying activity, for example employment or a board seat at a Portuguese entity.

AT confirms your status, typically by 31 March. IFICI applies from your first year of residency.

I work remotely for a US company, can I ever qualify?

Not on the remote arrangement as it stands. If your employer has no Portuguese entity and your role has no Portuguese economic connection, there is nothing for IFICI to attach to. You can qualify only if the arrangement changes, for example the employer sets up a Portuguese entity that employs you, or you take on a separate qualifying role in Portugal alongside or instead of the remote one.

You need a genuine qualifying activity in Portugal that matches one of the six IFICI routes. In practice that usually means employment by a Portuguese entity, a board or governing body position, a role at a certified Portuguese startup under Law 21/2023, or a research or R&D role at a recognised institution or SIFIDE certified company. The role has to be real, documented, and remunerated for work performed in Portugal.

Does a Portuguese branch of my employer count?

It can, because a branch gives the employer a Portuguese economic presence and your role can be exercised through it. What matters is that your employment is genuinely tied to that Portuguese establishment rather than the branch existing only on paper, and that the role fits one of the eligibility routes. This is worth assessing case by case before you rely on it.
