Crypto Tax in Portugal Under IFICI
Crypto tax in Portugal is a holding period regime that exempts gains on assets held 365 days or longer and taxes shorter holds at up to 28%.
Crypto tax in Portugal depends on how long you hold before selling and whether IFICI applies to you: standard Portuguese tax treats crypto gains as taxable at up to 28% if held under 365 days and exempt if held longer, while IFICI may exempt qualifying gains as foreign capital gains, though this should not be assumed without individual advice.

Start with the baseline that applies to every resident
Portugal's crypto rules are not an IFICI feature. They apply to all Portuguese tax residents, and for many people they are the only rules that matter. Get this layer straight before asking what a regime adds.

Crypto tax in Portugal: frequently asked questions
Crypto taxation is one of the areas where classification and sourcing are most contested, and outcomes turn on the detail of your own transaction history. This page does not constitute tax or legal advice. Have your position reviewed by a qualified adviser before acting on it.

the holding period that changes everything
Gains on disposal of crypto assets held for less than 365 days are treated as taxable capital gains, at rates of up to 28%. This is the standard Portuguese position and it applies to every Portuguese tax resident, whether or not any special regime is in play.
Gains on assets held for 365 days or longer are exempt under the standard regime. The holding period is measured per asset and per disposal, so the record keeping matters as much as the rule itself.
Not all crypto activity is a capital gain
Trading as a business activity, mining, validation, and staking rewards fall under different categories of income with their own treatment, and the holding period exemption does not extend to them. Where activity looks professional rather than occasional, the classification changes.
The exemption is framed around crypto assets that are not securities. Tokens that qualify as securities are taxed as securities, regardless of how long they are held.
IFICI works on sourcing, not on the asset
The regime exempts most categories of foreign source income for qualifying residents. Where a crypto gain is properly treated as a foreign source capital gain, an exemption can follow. The question is never the token, it is where the income is sourced and how it is classified.
Crypto has no obvious situs. Exchange location, custody arrangements, wallet control, and your own residency at the moment of disposal all feed into the analysis, and reasonable advisers can reach different conclusions on the same facts.
The standard exemption may already cover you
For a long term holder, the over 365 day exemption applies regardless of IFICI. In those cases IFICI adds nothing on the crypto side, and its value sits in your salary, dividends, and other income instead.
Is all crypto tax free in Portugal after one year?
For the standard regime, generally yes on gains, but that does not override the standard 28% rate on shorter holds. Assets held for 365 days or longer are exempt, assets sold earlier are taxable at up to 28%, and the exemption does not extend to activity that is not a capital gain, such as professional trading, mining, validation, or staking rewards. Tokens that qualify as securities are also outside it.
It can, for qualifying individuals, where a gain is properly treated as foreign source capital gain and therefore falls within the regime's exemption for most categories of foreign income. It is not automatic and it should not be assumed. Sourcing and classification of crypto gains are complex, and for a long term holder the standard over 365 day exemption may already deliver the same result without IFICI doing any work.
Do I need individual advice on this specifically?
Yes. This is one of the more genuinely complex areas of Portuguese tax, and it is one where we will not give you a general answer and call it a conclusion. The treatment depends on your holding periods, the nature of your activity, where and how the assets are held, and your residency at the time of each disposal. Have it reviewed by a qualified adviser on your actual transaction history before you rely on any outcome.
Does the holding period restart if I swap one token for another?
A disposal is a disposal. Swapping one crypto asset for another is generally treated as a realisation event, which means the holding period for the asset you receive begins on acquisition. Frequent swapping therefore works against the over 365 day exemption, and it can also push your activity towards being characterised as professional.
Do I still need to report crypto if it is exempt?
Exempt is not the same as invisible. Reporting obligations apply to residents and depend on the category of income and the amounts involved. Keep a full transaction record, including acquisition dates and costs, because the exemption is only as strong as the evidence behind the holding period.
* Cryptocurrency exemption should not be assumed without individual tax advice. The sourcing and classification of crypto gains can be complex.
